Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Campaigner PH platform ("Service", "Platform"), operated by Campaigner PH ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By accessing or using the Platform, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
Campaigner PH is an election campaign management platform that provides tools for voter tracking, beneficiary management, staff coordination, activity planning, expense tracking, and related campaign operations. The Service is provided on an "as is" and "as available" basis.
3. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials, including your password and any staff PINs associated with your campaign. You are fully responsible for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.
We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.
4. User Responsibilities
You agree that you will:
- Provide accurate, current, and complete information during registration and while using the Service
- Use the Service only for lawful purposes and in compliance with all applicable Philippine laws, including but not limited to the Omnibus Election Code, Data Privacy Act of 2012 (Republic Act No. 10173), and all COMELEC regulations
- Obtain proper consent from individuals before entering their personal information into the Platform
- Not use the Service for vote buying, voter intimidation, electoral fraud, or any illegal campaign activity
- Ensure that any staff members or volunteers you grant access to your campaign data understand and comply with applicable data protection laws
- Maintain your own backups of critical campaign data
5. Data Ownership and Responsibility
You retain ownership of all data you input into the Platform ("User Data"). You are solely responsible for the accuracy, legality, and appropriateness of all User Data. We do not claim ownership of your User Data.
You are the data controller of all personal information you store on the Platform. As the data controller, you bear full responsibility for ensuring your collection, storage, and processing of personal data complies with the Data Privacy Act of 2012 and its implementing rules and regulations, including obtaining proper consent from data subjects and registering with the National Privacy Commission (NPC) as required.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from the Service will be accurate or reliable
- The Service will meet your specific requirements or expectations
- Any defects in the Service will be corrected
- The Service will be free from viruses, malware, or other harmful components
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAMPAIGNER PH, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of (or inability to access or use) the Service
- Any unauthorized access to or use of our servers and/or any personal information stored therein, including any security breach, hack, data breach, or unauthorized disclosure of data
- Any interruption or cessation of transmission to or from the Service
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party
- Any errors, inaccuracies, or omissions in any content or data, or any loss or damage incurred as a result of the use of any content or data posted, emailed, transmitted, or otherwise made available through the Service
- The deletion, corruption, or failure to store any User Data or other content maintained by the Service
- Any decision made or action taken by you or any third party in reliance on the Service or its content
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY. IF YOU HAVE NOT PAID US ANYTHING, OUR MAXIMUM LIABILITY SHALL BE ONE THOUSAND PHILIPPINE PESOS (PHP 1,000.00).
8. Security Measures and Data Breach
We implement commercially reasonable security measures to protect User Data. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
You acknowledge and agree that you use the Service at your own risk. In the event of a data breach or security incident, our liability is limited as set forth in Section 7 above. We will make commercially reasonable efforts to notify affected users of any confirmed breach, but we shall not be liable for any damages arising from such a breach to the extent permitted by law.
You are responsible for implementing appropriate security practices on your end, including but not limited to using strong passwords, limiting staff access permissions, regularly reviewing your campaign's audit log, and revoking access for former staff members.
9. Indemnification
You agree to defend, indemnify, and hold harmless Campaigner PH, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation, including but not limited to election laws and data privacy laws
- Your collection, storage, or processing of personal data through the Platform
- Any third-party claims relating to data you entered or processed through the Service
- Any claim that your use of the Service caused damage to a third party
10. Acceptable Use
You agree not to:
- Use the Service for any purpose that is unlawful or prohibited by these Terms
- Attempt to gain unauthorized access to any part of the Service, other users' accounts, or any systems or networks connected to the Service
- Upload or transmit viruses, malware, or any other malicious code
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service to store or transmit content that infringes on the rights of any third party
- Scrape, crawl, or use automated means to access the Service without our express consent
- Resell, sublicense, or commercially redistribute the Service without prior written consent
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. We may delete your User Data after termination in accordance with our data retention practices.
You may terminate your account at any time through the Settings page. We are not obligated to retain your data after account deletion.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform with a revised "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
13. Third-Party Services
The Service may integrate with or contain links to third-party services (e.g., Google authentication, Cloudflare). We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and conditions.
14. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, power or internet outages, cyberattacks, pandemics, or other events of force majeure.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from or relating to these Terms or the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of the Philippines.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Campaigner PH regarding the Service and supersede all prior agreements, understandings, and representations.
